Constitution der evangelisch-lutherischen Salems Gemeinde ungeänderter Augsburger Confession zu Plumer's Settlement in Mills & Pottawattamie County Iowa.

Translation: Constitution of the Salem Evangelical Lutheran Congregation of the Unaltered Augsburg Confession in Plumer's Settlement in Mills & Pottawattamie County, Iowa.

Nachdem sich eine Anzahl evangelisch-lutherische Christen zu Plumer's Settlement in Mills und Pottawattamie County Iowa zu einer Kirchengemeinde vereint haben, so legen sie in den nachfolgenden §§ (Paragraphen) die Ordnung nieder, zu der sie sich durch Namensunterschrift verpflichten.

Translation: Having united themselves into a church congregation, a number of Evangelical Lutheran Christians in Plumer's Settlement in Mills & Pottawattamie County, Iowa, now set forth in the following articles the order to which by their signatures they obligate themselves.

§ 1

Unsere Gemeinde soll den Namen führen: "Die deutsche evangelisch-lutherische Salems Gemeinde ungeänderter Augsburger Confession zu Plumer's Settlement in Mills und Pottawattamie County Iowa."

Translation: Our congregation shall bear the name: "The Salem German Evangelical Lutheran Congregation of the Unaltered Augsburg Confession in Plumer's Settlement in Mills and Pottawattamie County, Iowa."

§ 2

Die Gemeinde bekennt sich zu dem Worte Gottes Alten und Neuen Testaments, wie solches in den sämtlichen symbolischen Büchern der evangelisch-lutherischen Kirche, vom Jahre 1580, dargelegt und erklärt ist und darum auch den Symbolen (Bekenntnisschriften) selbst. Dieselben sind: die drei allgemeinen Glaubenbekenntnisse, die ungeänderte Augsburger Confession und deren Apologie, die schmalkaldischen Artikel, der kleine und große Katechismus Dr. Martin Luthers und die Concordien Formel. Nach denselben sollen auch alle vorkommenden Religionsstreitigkeiten geschlichtet werden.

Translation: The congregation professes the Word of God of the Old and New Testaments as it is revealed and explained in all the confessional books of the Evangelical Lutheran Church of 1580 and thus also professes the Symbols (confessional writings) themselves. These are: the three universal confessions of faith, the Unaltered Augsburg Confession and its Apology, the Schmalkald Articles, the Small and Large Catechism of Dr. Martin Luther and the Book of Concord. All disputes of a religious nature that may arise will be settled in accordance with the same.

§ 3

In unseren Gottesdiensten und zum Unterricht in christlicher Lehre in unserer Gemeinde Schule können nur solche Bücher gebraucht werden, welche mit unserem Bekenntnis übereinstimmen.

Translation: Only such books as are in agreement with our confession can be used in our religious services and for instruction in the Christian faith in our parochial school.

§ 4

Niemand kann ein Glied oder Beamter der Gemeinde werden, noch weniger einen Teil an den Rechten eines Gemeindegliedes haben als:

wer getauft ist;

sich zu allen canonischen Büchern des Alten und Neuen Testaments als zu der einzigen göttliche Regel und Richtschnur des Glaubens und Lebens bekennt.

bei etwa vorhandenem Mangel an Kenntnis sämtlicher vorgenannter symbolischen Bücher zum wenigsten die Augsburger Confession und den kleinen Katechismus Luthers kennt und sich dazu bekennt.

(sich) nicht in offenbaren Werken des Fleisches übt, Gal. 5,19 - 21, sondern einen christlichen Wandel führt.

sich den Ordnungen, welche gemeinschaftlich festgesetzt sind und noch festgesetzt werden, soweit sie dem Wort Gottes nicht zuwider sind, unterwirft und sich in brüderlicher Liebe zurecht weisen läßt, wo er gefehlt hat.

Translation: No-one may become a member or officer of the congregation or even less so share in the rights of a congregational member unless:

he is baptized;
professes all the canonical books of the Old and New Testaments as the sole, divine standard and guiding principle for faith and life;
if possibly lacking in knowledge of all the above-named confessional books, he will at least know and profess the Augsburg Confession and Luther's Small Catechism;
does not practice manifest works of the flesh, Gal. 5: 19-21, but instead leads a Christian life;
submits to the rules which have been jointly ordained and are yet to be ordained, provided they are not contrary to the word of God, and allows himself to be rebuked in brotherly love when he has done wrong.

§ 5

Wer ein Mitglied unserer Gemeinde werden will, hat sich durch den Pastor oder einen Vorsteher in einer Versammlung anzumelden. Bis zur darauf folgenden Versammlung hat dann der Pastor der Gemeinde eine freundliche Besprechung über seinen Glauben und Bekenntnis mit ihm zu halten und der Gemeinde vor der Augnahme Bericht zu erstatten. Nach solchem Bericht findet seine Aufnahme dann statt, wenn zwei Mitglieder ihm ein gutes Zeugnis in öffentlicher Versammlung geben. Der Neuaufgenommene wird sodann vom Prediger auf unsere Constitution verpflichtet, welche er zu unterschreiben hat.

Translation: Anyone wishing to become a member of our congregation must apply through the pastor or an elder in a meeting. Before the next subsequent meeting, the pastor of the congregation shall have a friendly conversation with him concerning his faith and confession and report to the congregation before accepting him. After such a report, he will then be accepted if two members bear good witness of him in an open meeting. The pastor will then bind the newly accepted member to our constitution which he must sign.

§ 6

Jedes männliche Gemeindeglied hat, (illegible) unsere Gemeindeordnung unterschrieben, vom einundzwanzigsten (21) Lebensjahr an, Sitz und Stimme in allen öffentlichen Gemeindeversammlungen und Beratungen. Wählbar zum Vorsteher-Amte sind nur diejenigen, die das 25 ste Lebensjahr erfüllt und wenigstens ein Jahr Mitglied der Gemeinde waren.

Translation: Every male member of the congregation has, (illegible) signed our congregational charter, will have a seat and vote in all open congregational meetings and discussions from his twenty-first (21st) year on. Only those who are at least 25 years of age and have been a member of the congregation for at least one year are eligible to be elected to the office of elder.

§ 7

Jedes Mitglied der Gemeinde verpflichtet sich nach Kräften zur Erhaltung von Kirche und Schule beizutragen.

Translation: Every member of the congregation agrees to contribute to the upkeep of the church and school to the extent that he is able.

§ 8

Sollte eine Gemeindeglied in öffentliche Sünde fallen, so kann ein Ausschluß bloß dann geschehen, wenn die in Gottes Wort vorgeschriebenen Stufen der Ermahnung nach Matth. 18,15-20 fruchtlos angewandt worden sind. Dadurch verliert es alle Rechte eines Gemeindegliedes und allen Anspruch auf das Eigentum der Gemeinde, so lange bis es Buße tut. Was den Verlust der Rechte eines Gemeindegliedes und Anspruch auf Eigentum anbetrifft, bezieht sich auch auf diejenigen, welche sich freiwillig von der Gemeinde trennen oder ihren Wegzug eine solche Trennung bewirken, wenn sie dadurch ihre Verbindung mit der Gemeinde aufgeben.

Translation: In the event that a member of the congregation should fall into public sin, he may be expelled only if the steps of admonition prescribed in the Word of God in accordance with Matthew 18:15-20 have been applied without avail. Thereby he will lose all the rights appertaining to a member of the congregation as well as all claim to the property of the congregation until he repents. As far as the loss of rights as a member of the congregation and claim to property is concerned, it also applies to those who voluntarily separate themselves from the congregation or bring about such a separation by moving away, if in so doing they give up their connection with the congregation.

§ 9

Das Pfarr-Amt in der Gemeinde kann nur einem solchem Prediger übertragen werden, der sich zu allen canonischen Büchern Alten und Neuen Testaments als Gottes geoffenbartem Wort und zu den daraus abgeleiteten symbolischen Büchern der evangelisch-lutherischen Kirche dieses (§ 2) gedacht, - bekennt, worauf derselbe sowohl wie der Schullehrer bei seiner Vocation verpflichtet wird. Die Gemeinde behält sich füur alle Zeit das Recht vor, ihre Prediger und Lehrer, sowie alle sonstigen Beamten der Gemeinde selbst in öffentlicher Versammlung zu erwählen und zu berufen.

Translation: The office of pastor in the congregation may be entrusted only to a preacher who professes all the canonical books of the Old and New Testaments as the revealed Word of God and the confessional books of the Evangelical Lutheran Church derived from them as meant in § 2 of this document. Both he and the school teacher are obligated to this in their calling. The congregation reserves to itself for all time the right to choose and call its pastors and teachers as well as all other officers of the congregation in an open meeting.

§ 10

Alle Beamten der Gemeinde können von der Gemeinde in christlicher Ordnung ihres Amtes entlassen werfen. Gegründete Ursache zur Absetzung von Predigern und Schullehrern sind "Beharrliches Festhalten an falscher Lehre, ärgerlicher Wandel und mutwillige Untreue in der Amtsverwaltung."

Translation: All officers of the congregation can be relieved of their office by the congregation by following Christian order. A justified cause for the removal of preachers and teachers is "Stubborn adherence to false teaching, bad conduct and willful breach of trust in the performance of the duties of office."

§ 11

Die jedesmaligen Gemeindevorsteher haben nicht mehr und nur solange eine Gewalt in der Gemeinde, als ihnen von der Gemeinde übertragen wird. Die ihnen von der Gemeinde gegebenen Instruktionen können jederzeit auf Gemeindebeschluß hin verändert oder aufgehoben werden.

Translation: The respective elders of the congregation have no more authority in the congregation than is conferred upon them by the congegration and retain it only as long as the congregation confers it upon them. The instructions given to them by the congregation can be altered or revoked at any time by the decision of the congregation.

§ 12

Alles Eigentum der Gemeinde ist den jedesmaligen, von der Gemeinde erwählten Trustees dergestalt übergeben, daß sie dasselbe im Namen der Gemeinde als ihnen anvertrauten fremdes Gut verwalten, in Beziehung darauf Contracte abschließen, Gelder auszahlen, erheben und darüber quittieren, Documente unterschreiben, vor Gericht erscheinen und alle Handlungen vollziehen, die die Gemeinde als Eigentümerin selbst zu tun haben würde; jedoch der Gestalt, daß sie mit diesen Gütern nicht nach eigenem Willen oder Gutdünken zu schalten und zu walten befugt sind, sondern gedachte Handlungen nur nach gültigen Beschlüssen und Aufträgen der Gemeinde vollziehen. Dafür, was die Trustees auf Beschluß und im Auftrag der Gemeinde thun, hat letztere mit ihren Gütern zu stehen und die Trustees allenthalben schadlos zu halten; wenn dagegen die Trustees ohne Beschluß der Gemeinde nach eigenem Willen mit den Gemeinde Gütern verfahren, so sind sie der Gemeinde dafür persönlich verantwortlich.

Translation: All property of the congregation is entrusted to the respective trustees elected by the congregation in such a manner that they manage it in the name of the congregation as another person's property entrusted to them. In regard to this, they will conclude contracts, pay out and raise monies and give receipts therefor, sign documents, appear before the court and carry out all the actions that the congregation as proprietor would be required to do in its own behalf. However, they are not authorized to do this in such a way that they do manage these properties according to their own will or discretion; instead they will carry out the mentioned actions only in accordance with valid decisions and instructions of the congregation. The congregation must guarantee with its properties the actions carried out by the trustees following its decision and instructions and hold the trustees harmless in everything. However, if the trustees handle the congregation's properties according to their own discretion and without the decision of the congregation, they will be personally responsible to the congregation for this.

§ 13

Die Angelegenheiten der Gemeinde werden in regelmäßigen monatlichen (1/2 jährigen) Versammlungen beraten. Zu einem Gemeindebeschluß wird die Übereinstimmung von wenigstens zwei drittel der anwesenden Gemeindeglieder erfordert. In Sachen der Lehre jedoch und des Gewissens ist eine Einstimmigkeit nötig. Jedes Gemeindeglied ist verpflichtet die Versammlungen womöglich zu besuchen. Der Ausbleibende leistet auf sein Stimmrecht für den Fall seines Nichterscheinens Verzicht.

Translation: The business of the congregation will be discussed in regularly scheduled monthly (semi-annual) meetings. A congregational decision requires the concurrence of at least two-thirds of members of the congregation present. However, in matters of teaching and conscience, unanimity is necessary. Every member of the congregation is obligated to attend the meetings whenever possible. The absent member waives his voting right in the event of his failure to attend.

§ 14

Sollte, was Gott gnädig verhüten wolle, in der Gemeinde eine Trennung entstehen, so verbleibt das Eigentum und alle damit verbundenen Vorteile der Gemeinde, demjenigen Teil derselben, welcher an den Bestimmungen der §§ 2, 3, 4, 8, 9, 10 und 14 festhält. Es sind deshalb diese letztgenannten Paragraphen für alle Zeit unveränderlich.

Translation: May God in His Grace prevent it, but in the event that a schism should arise in the congregation, the property and all the benefits of the congregation attaching thereto shall remain with that part which adheres to Articles 2, 3, 4, 8, 9, 10 and 14. For that reason, these last named articles shall be unalterable for all time.

Nebengesetze (Supplementary Ordinances)

Die Vorsteher betreffend, so soll sich die Zahl derselben auf vier (4) belaufen, deren Amtszeit zwei Jahre dauert, doch so, daß jedes Jahr zwei neue gewählt werden. Die Wahl der Vorsteher soll am ______ im Monat ______ jedes Jahres abgehalten werden.

Translation: In regard to the elders, they shall be four (4) in number and their term of office shall be two years but they shall be elected in such a way that two new ones will be elected each year. The election of the elders shall be held on the ______ day of the month of ______ of each year.

Die Trustees betreffend, so soll sich die Anzahl derselben auf 3 belaufen, welche ihrem Amte 3 Jahre vorstehen sollen, jedoch so, daß im Jahr 1 neuer gewählt wird. Die Wahl derselben, sowie aller Beamten der Gemeinde soll durch Stimmzettel geschehen. Die Wahl der Trustees soll immer am ______ im Monat Januar jedes Jahres abgehalten werden.

Translation: In regard to the trustees, they shall be 3 in number and will hold office for 3 years but they shall be elected in such a way that 1 new one will be elected each year. Their election, as well as all officers of the congregation shall occur by means of ballot. The election of the trustees shall always be held on the ______ day of the month of January of each year.
